Terms of Service

1. Acceptance of Terms

By accessing or using TidalListings ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

TidalListings is an online marketplace that allows property owners and licensed real estate agents to list waterfront properties for sale or rent. TidalListings is NOT a real estate agency and does not facilitate transactions, provide real estate advice, or take commissions on sales.

3. User Accounts

You must create an account to list properties or contact sellers. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

4. Listing Fees

Each active listing requires a $22/month subscription. Subscriptions are billed monthly via Stripe. You may cancel at any time; your listing will remain active until the end of the current billing period.

5. Listing Content

You are solely responsible for the accuracy and legality of your listing content. Listings must not contain discriminatory language, misleading information, or contact information in the description field (use the dedicated contact fields instead). TidalListings reserves the right to remove any listing that violates these terms.

6. Prohibited Conduct

You agree not to: post fraudulent listings, harass other users, attempt to circumvent the platform's messaging system, scrape or data-mine the Service, or use the Service for any illegal purpose.

7. Intellectual Property

TidalListings and its original content, features, and functionality are owned by TidalListings and are protected by international copyright, trademark, and other intellectual property laws.

8. Limitation of Liability

TidalListings is provided "as is" without warranties of any kind. We are not liable for any damages arising from your use of the Service, including but not limited to property transactions, disputes between users, or loss of data.

9. Changes to Terms

We reserve the right to modify these terms at any time. Continued use of the Service after changes constitutes acceptance of the new terms.

11. Governing Law

These Terms are governed by the laws of New Zealand. Any disputes arising from these Terms or your use of TidalListings shall be subject to the exclusive jurisdiction of the courts of New Zealand, without regard to conflict of law provisions. If you are accessing the Service from another jurisdiction, you are responsible for compliance with local laws.

12. Subscription Auto-Renewal

Listing subscriptions automatically renew monthly at $22 USD per listing until cancelled. You will receive an email notification before each renewal. You may cancel at any time from your dashboard; your listing will remain active until the end of the current billing period. No refunds are issued for partial billing periods. Subscription management is handled by Stripe.

13. User Content Licence

By uploading photos, descriptions, and other content to TidalListings, you grant TidalListings a non-exclusive, worldwide, royalty-free licence to display, reproduce, and distribute that content solely for the purpose of operating and promoting the Service. You retain full ownership of your content. This licence ends when you delete your listing or account.

14. Dispute Resolution

In the event of a dispute between users (buyers and sellers), TidalListings is not a party to the dispute and has no obligation to resolve it. TidalListings is a listing platform only — we do not facilitate, guarantee, or take responsibility for any property transactions. Users are encouraged to seek independent legal advice for any property-related disputes.

15. International Users

TidalListings is accessible globally. By using the Service, international users agree that their data may be stored and processed in servers located outside their home country (currently US East via Supabase). We comply with applicable data protection laws including the New Zealand Privacy Act 2020.

16. Platform Only — No Agency Work

TidalListings is a listing platform only. We do not carry out real estate agency work as defined under the Real Estate Agents Act 2008 (New Zealand). We do not act on behalf of sellers, we do not negotiate on behalf of any party, and we do not receive commission on any property transaction. Users who are licensed real estate agents listing properties on behalf of clients do so under their own licence and obligations.

17. Consumer Guarantees

TidalListings will carry out its services with reasonable skill and care as required under the Consumer Guarantees Act 1993 (New Zealand). Our platform messaging, listing tools, and payment systems are designed and maintained to be fit for purpose. If you experience a platform issue, contact support@tidallistings.com.
